What Are “Policy Limits”?

Most people and businesses carry liability insurance. A policy limit is the maximum amount an insurance company is legally obligated to pay for a claim under that policy. Once those limits are paid, no additional insurance money is available.
Although it is theoretically possible to collect from a negligent driver’s personal assets, in practice, this is extremely rare because most individuals do not have recoverable assets that can actually produce money in a client’s pocket.
So when we recover policy limits, we are obtaining every dollar that is realistically collectible for the client.

What does Litigation Mean?

Litigation is, at times, the only way to resolve a matter. This means a lawsuit was filed in the county where either the defendant lived or the accident occurred. Depositions were taken, discovery was exchanged, and the cases were settled before the trial date.


The following cases were settled before trial but required litigation to resolve:

Policy Limit Settlement

$200,000 — Rear-end Collision by Elderly Driver

Summary: Achieved for a working mom with pre-existing back and neck injuries. Her back and neck were made worse by the collision. Defense argued that her injuries were soft tissue in nature and should have resolved in six weeks. Our testifying treating doctor testified to objective changes on her MRIs before and after the collision (Note: all of these images were provided to defendants prior to filing a lawsuit). The case settled for policy limits shortly after the deposition of the treating doctor. The UIM claim of $100,000 resolved 30 days after the litigated matter for a total recovery of $200,000.

$100,000 — Rear-end Collision by Teenage Driver

Summary: Achieved for a lady with pre-existing back injuries made worse by the subject collision. This case resolved shortly after filing and serving the defendant with the lawsuit.

Policy Limits Settlement

$325,000 — Multi-vehicle Collision by Reckless Driver

Summary: Multiple people were injured in this reckless crash with limits insurance to go around. We filed suit on the negligent driver's policy and reached a pro-rata settlement for our client and maximized her recovery under her own policy of insurance. The client was then in another crash 30 days after the initial crash, complicating the matter, and we were able to provide her with additional compensation from the limited insurance policies available.
